On February 11, Lawmakers assembled in Saint Paul for the first day of their 2020 legislative session, where a bill is set to be proposed to legalize recreational marijuana in Minnesota.

While eleven states and Washington, D.C. have already legalized marijuana for recreational purposes, only medical marijuana for certain conditions is allowed in Minnesota, excluding edibles or smokable forms of marijuana.  2019 Minnesota Statutes currently prohibit the possession and sale of marijuana for recreational use; It is fundamental to be aware of the hefty consequences including high fines and jail time can follow if broken:

  • A first offense with possession or sale without remuneration (exchanged payment) of less than 42.5 grams of marijuana is a petty misdemeanor punishable by a maximum $200 fine as well as a possible drug education course.
  • Possession or sale of quantities larger than 42.5 grams of marijuana is a felony. Depending on the amount of marijuana possessed or sold, the felony may be punishable by a maximum of $1,000,000 and up to 5–35 years incarcerated.
  • Sale of marijuana to a minor is a felony punishable by a maximum $250,000 and up to 20 years incarcerated.
    Additional infringements may face higher penalties.
