Photographs of anything in your plain sight, including police, can be legally taken if you are lawfully present in a public space, and cannot be confiscated or deleted without a warrant. Different states have varying rules about sharing the audio portion of a video without consent from the recorded individuals, but the First Amendment always protects the visual aspect of a photo or video.
